Privacy Policy
Effective date: October 15, 2026
Evalution Coaching & Consulting, LLC (“Company,” “we,” “us,” or “our”) is a Florida Limited Liability Company providing coaching and consulting services through Eva Gagnon.
This policy explains how we handle personal information associated with our website, inquiries, newsletters, enrollment, coaching services, and payments, including the Rebirth, Resonance and Realign service offerings.
1. Information We Collect
Depending on how you interact with us, we collect:
Contact information: Name, email address, telephone number, and mailing or billing address.
Enrollment records: Forms, intake responses, agreements, consent choices, scheduling information, and electronic acceptance records.
Coaching information: Goals, reflections, communications, coaching notes, and information you choose to share. This may include sensitive information about health, emotional well-being, relationships, and personal circumstances.

Authorized recordings and transcripts: Where separately consented to and legally permitted.
Website information: IP address, browser and device information, pages visited, referral information, timestamps, and information collected through cookies and analytics.
Newsletter information: Email address, subscription and consent records, preferences, and email engagement information, such as opens or clicks where enabled.
We receive information directly from you and through providers supporting our website, communications, services, and payments. Please do not send full payment-card numbers, passwords, or unnecessary sensitive information by ordinary email.
2. Purposes of Processing
We use information as appropriate to:
Respond to inquiries and communicate with you.
Assess whether our services are suitable for your needs.
Administer enrollment, agreements, scheduling, and access.
Provide coaching and agreed resources.
Process payments, installments, refunds, and billing inquiries.
Maintain necessary service and consent records.
Send occasional newsletters in accordance with applicable law and required consent.
Understand website use and improve functionality.
Protect security and investigate suspected fraud or misuse.
Meet applicable legal, tax, accounting, and professional obligations.
Establish, exercise, or defend legal claims.
Where applicable law requires a particular legal basis or separate consent, we identify and use the appropriate basis or consent process. This policy does not replace a required consent. You may decline to provide optional information. If information is necessary to administer a purchase or provide an agreed service, not providing it may prevent us from completing that activity.
3. Service Providers and Other Recipients
We use:
Squarespace: Website hosting and Squarespace Analytics.
Dubsado: Client forms, agreements, invoices, payment administration, and authorized autopay.
Google Workspace: Business email and scheduling.
Zoom: Video sessions and authorized recording and transcription.
ThriveCart: Checkout and payment-plan administration.
Stripe: Payment processing.
Kit, formerly ConvertKit: Newsletters and subscription administration.
If PayPal is offered and selected, PayPal processes the applicable payment. Another invoicing or payment provider, if used, will be identified in the applicable instructions or interface. We may change providers for reasonable operational needs. We limit disclosures to information reasonably necessary for the applicable function and use appropriate provider arrangements and safeguards as required by applicable law. A provider change does not itself authorize a new purpose for using your information. Providers’ processing is governed by applicable law, their arrangements with us, and their applicable privacy notices. We may also disclose relevant information to professional advisers, where required by law or valid legal process, for applicable reporting obligations, to address serious safety concerns where legally permitted or required, or with your specific authorization. Disclosures remain subject to applicable legal restrictions and confidentiality obligations.
4. Business Administration and AI Tools
We use Claude and ChatGPT for general business administration, workflow development, and systems support. We do not submit identifiable client information to those tools for these purposes. Zoom recording and transcription, where separately authorized, are governed by the recording and transcription provisions of this policy and your signed agreement. Before introducing a materially different use of client information, we will provide any required notice and obtain any additional consent or authorization required by applicable law.
5. Newsletters
We use Kit for occasional newsletters. Depending on enabled settings, Kit processes subscription information and email engagement information. You may unsubscribe through the link in a newsletter or by contacting eva@evalution.io. Unsubscribing does not stop necessary communications about an existing Program, agreement, or payment. We may retain limited consent and unsubscribe records to document your choices and prevent unwanted resubscription. Checkout acceptance and recording consent are separate from newsletter consent.
6. Cookies, Analytics, and Browser Privacy Choices
Our website uses Squarespace Analytics to understand website visits and interactions. Squarespace uses necessary cookies to support website functions and optional analytics/performance cookies to help measure website use. Our cookie banner allows you to accept, decline, or manage nonessential cookies. Squarespace’s optional analytics/performance cookies are restricted until you consent. You can revisit your choices through the “Cookie Preferences” control. Squarespace has informed us that its native website features do not currently respond automatically to browser Do Not Track or Global Privacy Control signals. These browser signals are separate from the choices available through our cookie banner. Squarespace has also informed us that it does not disclose information about visitors to our website for advertising purposes. These statements concern Squarespace’s native features. Third-party services accessed through links, forms, or other integrations may have separate privacy practices and controls. Please review their privacy notices when using those services. Browser settings may provide additional controls, although blocking cookies does not necessarily prevent all technical information from being processed. We do not intentionally send client intake responses, coaching notes, session content, or identifiable sensitive information to website analytics services.
7. Coaching Confidentiality
Coaching information is handled according to your signed agreement and applicable confidentiality requirements. This policy does not create a psychotherapist-client relationship or determine whether evidentiary privilege applies. The nature of services and limits to confidentiality are described in your agreement. Sensitive information is subject to any additional protections or consent requirements imposed by applicable law.
8. Recording and Transcription
For Rebirth, Resonance & Realign Section 17.7 of your signed agreement governs recording and transcription. You may decline or withdraw consent for future recording or transcription by written notice without affecting participation. Under that provision, withdrawal also ends future use of existing recordings and transcripts for internal service improvement. It does not require deletion of records otherwise lawfully retained or invalidate prior authorized recording, transcription, or use. Recordings and transcripts remain subject to confidentiality protections. Recording consent does not authorize public disclosure or marketing use. Accepting this policy or checkout terms does not grant recording consent.
9. International Processing
Company is based in the United States. Information may be processed in the United States and other countries where our providers operate, including when you interact with us from your rfrom your country of residence or another country. Privacy laws differ between countries. International processing is subject to any safeguards, notices, permissions, and other requirements applicable to the transaction. Using our services does not waive mandatory privacy rights or constitute unrestricted consent to international transfers. Contact us for information about applicable processing locations and transfer safeguards.
10. Retention
We retain essential client records - including agreements, consent records, payment authorizations, essential intake information, coaching notes, and material client communications - for seven years after the later of Program completion or termination, or final payment, unless applicable law requires a different period. We limit retained information to what is reasonably necessary for its purpose. Duplicate or unnecessary information may be removed sooner.
For Rebirth, Resonance & Realign:
Recordings: Deleted when the Program is completed or participation ends early, taking account of any agreed written extension.
Transcripts: Retained for six months after completion or effective early termination, then deleted.
Nonclient inquiries: Deleted six months after the last meaningful interaction unless separately needed for a lawful purpose. A separately authorized newsletter subscription is handled independently.
Necessary information documented in coaching notes follows the essential-client-record retention period. We ordinarily retain supporting financial records for seven years after the relevant tax return is filed, subject to applicable requirements. Newsletter information is retained while the subscription remains active, with periodic reviews of inactive subscriptions. Limited consent and suppression records are retained as reasonably needed to document choices and prevent unwanted resubscription. Technical and analytics retention depends on the collection purpose, configured provider settings, and applicable requirements. These periods are subject to legal and professional requirements. We suspend deletion of relevant records when required for a complaint, investigation, pending or reasonably anticipated dispute, or another preservation obligation. Deletion includes copies under our control. Residual backups may remain until overwritten through the applicable backup process and are not used for ordinary business purposes. Nothing here authorizes a use prohibited by your consent or limits a deletion right that must legally be honored. Ending online Program access does not necessarily delete underlying Company records.
11. Security
We use reasonable safeguards appropriate to the information handled and limit access according to legitimate responsibilities. No transmission or storage method is completely secure. We assess incidents and fulfill applicable response and notification duties.
12. Your Rights, Requests and Choices
Depending on applicable law, you may have rights concerning access, correction, deletion, portability, restriction, objection, withdrawal of consent, or complaints. Email eva@evalution.io with the subject “Privacy Request.” Describe your request and provide enough information to identify the relevant records. We may need to verify your identity or authority. We respond within applicable deadlines and explain lawful limitations. Withdrawal of consent does not invalidate prior lawful processing. Some records must be retained for legal obligations or claims. You may also complain to the relevant privacy authority where that right applies. Contacting us first is not a prerequisite to exercising that right.
13. Adult Services
Our coaching services are intended for adults eighteen or older. We do not knowingly enroll children. Contact us if you believe a child has provided information so we can assess and address the matter.
14. Changes and Relationship to Your Agreement
We may update this Privacy Policy from time to time when practices or requirements change and identify the current version by its effective date. Updates will be posted on this page. For material changes, we provide additional notice or obtain consent where required, including direct notice where appropriate. This policy describes information-handling practices. Its publication or revision does not amend your signed agreement’s tuition, payment schedule, refund rights, confidentiality obligations, or recording-consent choices. An update does not authorize a new use of existing information where additional permission is required.
